Senators Deserve to See Missing Documents from Judge Gorsuch’s Time at Department of Justice, Publications He Wrote for the Republican National Lawyers Association

 

It has been weeks since Judiciary Committee Chairman Chuck Grassley (R-IA) and Ranking Member Dianne Feinstein (D-CA) requested documents relevant to the nomination of Judge Neil Gorsuch to the Supreme Court. The senators requested documents from Judge Gorsuch’s time at the Department of Justice, related to his nomination to the U.S. Court of Appeals, and regarding a leadership position he held in the Republican National Lawyers Association.

 

Yesterday, Senator Richard Blumenthal (D-CT) sent letters to the Heritage Foundation and the Federalist Society requesting all documents related to the selection of Judge Neil Gorsuch, as it was well-reported that President Trump was “largely outsourced” the choice of his Supreme Court justice nominee to these right-wing organizations.

 

Given the lack of documents produced on and from Judge Gorsuch, we have to ask: What is Judge Gorsuch hiding?

 

Documents from the Bush Presidential Library

 

On February 13, Judiciary Committee Chairman Chuck Grassley (R-Iowa) and Ranking Member Feinstein sent a letter to the director of the Bush Presidential Library requesting all documents related to Neil Gorsuch including those related to his nomination to the U.S. Court of Appeals for the Tenth Circuit. The request also covers all emails between Neil Gorsuch and White House staff while Judge Gorsuch served as Principal Deputy Associate Attorney General, a high-ranking leadership position in the George W. Bush Justice Department.

 

Documents and Information from the Department of Justice

 

On February 21, Chairman Grassley and Ranking Member Feinstein sent a letter to Attorney General Sessions requesting all documents related to Neil Gorsuch’s time at the Justice Department.

 

On February 22, Ranking Member Feinstein sent a letter to Judge Gorsuch requesting information regarding his role with respect to 10 specific cases that the Department of Justice was litigating during his time at the Justice Department. The letter also requested a list of other significant cases in which Judge Gorsuch played a role, as well as all the policies and initiatives in which he “assisted in the development and implementation.”

 

Documents and Information from Judge Gorsuch’s Participation in the Republican National Lawyers Association

 

On February 22, Ranking Member Feinstein sent a letter to Judge Gorsuch requesting information regarding his participation in the Republican National Lawyers Association, including his leadership role of the Association’s Judicial Confirmation Task Force. The letter also requests op-eds that Judge Gorsuch wrote on behalf of the RNLA that should have already been provided to the committee for review.

 

Documents from the Heritage Foundation and the Federalist Society

 

On March 6, Senator Blumenthal sent letters to the Heritage Foundation and the Federalist Society requesting all documents related to their choice of Judge Neil Gorsuch to be nominated to the Supreme Court. As it has been widely reported, President Trump “largely outsourced” the decision on Supreme Court nominees to these two organizations.
